1. Acceptance of these terms

Welcome to HolidayLandmark. These Terms of Service ("Terms") govern your access to and use of the HolidayLandmark website and services (the "Platform"). By using the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.

2. What HolidayLandmark is

HolidayLandmark is a local tourism marketplace. We help travellers ("Travellers") discover and connect with local tourism service providers ("Organizers") such as guides, homestay owners, food hosts, transport providers, adventure operators and trip organizers.

HolidayLandmark provides a discovery and booking-request platform. We are not a tour operator, travel agency, or party to the agreement between a Traveller and an Organizer. The experience itself is provided by the Organizer.

3. Accounts & eligibility

To use certain features you may need an account. You agree to provide accurate information, keep your credentials secure, and be responsible for activity under your account. You must be able to form a legally binding contract to use the Platform.

4. Booking requests & direct payment

The Platform operates on a booking-request and direct-payment basis. Travellers send a request to an Organizer, who may accept or decline. Once accepted, the Traveller and Organizer coordinate the details directly.

• Payment is arranged directly between the Traveller and the Organizer. HolidayLandmark does not process payment for experiences in this phase and is not responsible for payments, refunds or pricing agreed between users.
• Always confirm price, inclusions, cancellation terms and arrangements directly with your Organizer before you travel.

5. Organizer responsibilities

Organizers are responsible for the accuracy of their listings, the legality of the services they offer, holding any licences or permits required in their location, and delivering experiences as described. Listings are reviewed before publication, but review does not guarantee any outcome.

6. Traveller responsibilities

Travellers are responsible for assessing whether an experience is suitable for them, following local laws and the Organizer's reasonable instructions, and using good judgement when travelling. Some activities carry inherent risks.

7. Verification, reviews & conduct

Verification badges indicate information that has been reviewed by HolidayLandmark; they are not a guarantee. Reviews may be left only by Travellers with a completed booking. You agree not to post false, misleading, unlawful or abusive content, and not to misuse contact details obtained through the Platform.

8. Intellectual property

The HolidayLandmark name, logo, design and Platform content are owned by HolidayLandmark or its licensors. Content you submit remains yours, but you grant HolidayLandmark a licence to host and display it for the operation and promotion of the Platform.

9. Disclaimers & limitation of liability

The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, HolidayLandmark is not liable for the acts or omissions of Organizers or Travellers, for experiences booked through the Platform, or for any indirect or consequential loss arising from your use of the Platform.

10. Changes & termination

We may update these Terms or the Platform from time to time. Material changes will be reflected by updating the date below. We may suspend or terminate access for conduct that breaches these Terms or harms other users.

11. Governing law

These Terms are governed by the laws applicable to HolidayLandmark's operations, without regard to conflict-of-law principles. Where required, mandatory consumer protections in your country of residence still apply.
